Terms and Conditions of Travel

 

Avatarwhitsundays.com.au must abide by the Travel Companys (OzSail) terms and conditions

For Travel on Avatar Whitsundays these terms and conditions are as follows as per the supplier of the tour.

AP Vessel Management Pty Ltd ABN 45086439198 t/as OzSail Skippered Charter Yachts (OzSail ®).

All prices are shown in Australian dollars and are inclusive of GST. Prices valid from 1st April 2016. All departures and itineraries are subject to weather and may be changed or cancelled at OzSail’s discretion. OzSail reserves the right to substitute vessels without notice at any time and for any reason. If a trip is not completed due to unforeseen circumstances or depart as scheduled all guests will be resupplied a ticket for the equal value on a Ozsail vessel to travel again at the earliest availability, this includes but not limited to weather, mechanical and personal injury.

Cancellations less than 21 days before cruise departure will result in the complete forfeiture of the full price. This includes 3rd party transport in getting to the departure point. Transfers at least 72 hrs before the day of scheduled departure will incur a $30 transfer fee. No Transfers will be accepted under this 72 hr period

We recommend you take out travel insurance

You acknowledge that travel with, and the recreational services provided by, OzSail involve risk, including but not limited to a risk of being stung by jellyfish.

Whilst we make every effort to safeguard passengers, OzSail is not liable for personal injury, loss or death (including but not limited to from jellyfish stings) and OzSail hereby excludes absolutely all liability for direct and indirect loss, howsoever arising and whether or not arising in the course of the trip.

Where the Competition and Consumer Act (CCA) consumer guarantees apply the liability of OzSail for any breach of those consumer guarantees is limited to the maximum extent possible under section 64A and 139A of the CCA, where you are killed, injured or contract a disease because OzSail’s services were not provided in accordance with the consumer guarantees.
